Reflecting on the Supreme Court’s affirmative action ruling

Diversity, equity, inclusion and belonging are vital components of a just society, and affirmative action measures are necessary to address the systemic barriers that have historically disadvantaged marginalized groups. I encourage all our members to engage in constructive dialogue, educate others about the importance of affirmative action and advocate for policies that promote equity and inclusivity.

Dear Philanthropy Ohio members,

As we head into the holiday weekend, we do so with reflection on Thursday’s Supreme Court of the United States ruling, which has dealt a blow to affirmative action and is a setback in the pursuit of social justice and equal access to education and employment opportunities.

Many funders in our network recognize the importance of affirmative action in promoting equality and creating opportunities for underrepresented communities. We believe that diversity, equity, inclusion and belonging are vital components of a just society and that affirmative action measures are necessary to address the systemic barriers that have historically disadvantaged marginalized groups.

We understand that the issue of affirmative action is complex and multifaceted, with differing viewpoints. However, we acknowledge that affirmative action has played a pivotal role in expanding access to higher education and breaking down barriers that hinder progress. It has helped level the playing field for marginalized communities, ensuring that qualified individuals from all backgrounds have a fair shot at success. By promoting diversity on college campuses and in workplaces, affirmative action fosters an environment where ideas can be exchanged, perspectives can be broadened and prejudices can be challenged.

We also recognize that the recent ruling does not eradicate the progress made through affirmative action entirely. However, it does underscore the need for our continued advocacy and dedication to achieving equality for all. We must remain resolute in our commitment to dismantling systemic racism and promoting inclusivity, even in the face of adversity.

Together, we can effect positive change and build a future where every child has an equal opportunity to succeed.

I encourage all our members to engage in constructive dialogue, educate others about the importance of affirmative action and advocate for policies that promote equity and inclusivity.

We believe that the implications of the ruling will likely reverberate to cause questions or examination of other equity efforts across multiple fields, including philanthropy and the nonprofit sector. Below are ideas for engagement, as philanthropy at the national level is collaborating to respond through multiple strategies:

  1. Creating a fund(s) for nonprofits to access legal counsel if they are challenged on their race-explicit work.
  2. Building and maintaining a resource bank that provides tools and strategies for foundations and nonprofits to navigate backlash on racial equity.
  3. Providing resources to civil rights groups working to defend nonprofits and foundations on these issues.
